When it comes to maternity leave, most people expect that it is paid benefit offered by all employers when, in all actuality, it is not. Maternity leave will generally fall into one of two categories ; your typical maternity disability or medical leave and family medical leave (FMLA).

I’m concerned that this could be viewed as a discrimination issue, since we are treating male and female employees differently and we aren’t having to abide by any federal legislation. Surely allowing women to take the 6-8 weeks off is okay because giving birth necessarily means you are "disabled" for that time period.

Basically, something I didn’t see discussed is this: most women are nervous when they announce their pregnancy at work. But more than that, they know they risk discrimination against them by their employer for having a baby. We also know that women have their duties reassigned while they’re on maternity leave and never get them back and that some companies find excuses to lay women off when they’re pregnant or on maternity leave.
