Due to the fact that it is non-taxable, the amount will not be reported on the end of the year W-2 form. If the educational assistance provided at your company is over $5,250, the amount over the maximum tax-free assistance allowed will be considered a part of the individual’s wage, must be reported on box 1 of the employee's W-2, and will be taxed at the end of the year in most cases--unless it can be considered a work-related education fringe benefit (more on that in a second).

That position ended last year, and since then I have been employed in an hourly wage position with lower per-hour pay and no benefits. My W-2 from last year is only from a partial year and I’ve since received a raise. If I use hard salary numbers from 2012, it doesn’t reflect the variability of my hours and the fact that my boss thinks I’m worth $X per hour — it would appear that my wages were much lower per hour than they really are.

Any one of these complaints — breaking the law by paying you as an independent contractor when you meet the legal test for an employee, paying less than the rate you agreed to, paying you less than minimum wage, and/or dismissing harassment concerns — would be reason to leave on its own. It causes additional stress that I really don’t need at the end of the year when I’m already gearing up for year end taxes, W-2’s, 1099’s, etc. Is there a “rule of thumb”, i.e. one month’s salary, 5% of gross wages, etc., It’s five answers to five questions. Here we go…. My employee strategically left out coworkers from his holiday party and generally behaves like a jerk. I am the owner, founder, and managing partner of a small law firm.
